Waste Removal Barnet Service Terms and Conditions

These Terms and Conditions govern all waste removal and related services provided by Waste Removal Barnet to consumer and business customers. By making a booking, confirming a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions in full.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting or receiving our services.

Company, we, us, our means Waste Removal Barnet, the service provider.

Services means any waste removal, collection, clearance, loading, transportation, or disposal work carried out by us.

Waste means any items, materials, rubbish, refuse, junk, furniture, appliances, garden waste, construction waste, or other matter we are requested to remove, excluding any items we specifically refuse to handle.

Site means the property, premises, building, land, or location where the Services are to be carried out.

Booking means a confirmed request for Services made by the Customer and accepted by the Company.

2. Scope of Services

2.1 We provide waste removal and collection services including, but not limited to, household waste clearance, bulky waste collection, garden waste removal, and light commercial clearances.

2.2 The exact scope of the Services will be agreed at the time of quotation or booking, based on the description of the waste to be removed and access to the Site.

2.3 We reserve the right to decline or discontinue any part of the Services where, in our reasonable opinion, there is a safety risk, a risk of property damage, or a risk of breaching applicable laws or regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any booking system we make available. A booking is not confirmed until we have acknowledged it and provided a date and approximate time window for attendance.

3.2 The Customer is responsible for providing accurate information about the type and approximate volume of waste, access to the Site, parking arrangements, and any special circumstances that may affect the work.

3.3 Any estimate given prior to our arrival is based on the information supplied by the Customer and is not binding. The final price will be confirmed on-site once our operatives have inspected the waste and assessed the work required.

3.4 Where access or circumstances at the Site differ significantly from the Customer's description, we may revise the quotation, alter the Services, or refuse to proceed if it is not safe or reasonable to do so.

4. Quotations and Pricing

4.1 Our charges are generally based on the volume, weight, and type of waste collected, together with any additional labour, access, or disposal costs that may apply.

4.2 Any quotation provided, whether written or verbal, is an estimate only until confirmed on-site. Quotations are normally valid for a limited period, which we will specify at the time they are issued.

4.3 Prices may vary depending on the nature of the waste, including, for example, heavy or dense materials, special handling requirements, or items requiring separate treatment under waste regulations.

4.4 All prices will be stated in pounds sterling and will specify whether they are inclusive or exclusive of VAT, if applicable.

5. Payments and Invoicing

5.1 Unless agreed otherwise in writing, payment is due in full at the time the Services are completed, and in any event before our operatives leave the Site.

5.2 We may accept cash, card payments, bank transfers, or other payment methods as notified to the Customer. We reserve the right to refuse certain methods of payment.

5.3 For business Customers who have an account with us, invoicing terms may be agreed in advance. Payment must be made in accordance with the payment terms stated on the invoice.

5.4 If any payment is not received when due, we may charge interest on the outstanding amount at the statutory rate permitted under UK law, as well as reasonable recovery costs we incur in pursuing late payments.

5.5 We reserve the right to withhold or suspend Services, or to cancel future bookings, if any sums due from the Customer remain unpaid.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting us during our normal office hours.

6.2 If the Customer cancels a booking more than 24 hours before the agreed arrival time, no cancellation fee will normally apply, unless specific arrangements have been made that incur non-refundable costs.

6.3 If the Customer cancels a booking within 24 hours of the scheduled arrival time, we may charge a reasonable cancellation fee to cover our administrative and scheduling costs.

6.4 If our operatives attend the Site at the agreed time and are unable to carry out the Services for reasons within the Customer's control, including lack of access, incorrect address, or insufficient parking provision, we may charge a call-out fee and the Customer may be liable for all or part of the quoted charges.

6.5 We reserve the right to cancel or reschedule a booking where necessary due to vehicle breakdown, staff illness, severe weather, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will use reasonable efforts to notify the Customer and to arrange an alternative time.

7. Customer Obligations

7.1 The Customer must ensure that we have safe and reasonable access to the Site and to the waste that is to be removed. This includes arranging any required parking or permits and ensuring that access routes are clear.

7.2 The Customer must identify and clearly separate any items that are not to be taken, and must give clear instructions about which items or areas are to be cleared.

7.3 The Customer must not request the removal of any items that are hazardous, prohibited, or illegal for us to transport or dispose of, including but not limited to asbestos, certain chemicals, medical waste, or pressurised containers, unless we have expressly agreed in writing and are authorised and equipped to handle such materials.

7.4 Where a Customer is not present at the Site, they must ensure that adequate instructions, access arrangements, and contact details are provided so that our operatives can carry out the agreed Services.

8. Waste Regulations and Environmental Compliance

8.1 We operate in accordance with applicable UK waste legislation and regulations, including the duty of care for controlled waste. We will only transport and dispose of waste at authorised facilities.

8.2 Upon completion of the Services, we will take responsibility for the waste we have collected and will manage it in compliance with our legal obligations, including recycling and recovery where practicable.

8.3 The Customer confirms that they are the owner of the waste or have the authority of the owner to arrange its removal and disposal.

8.4 We may refuse to remove any waste that we reasonably believe would cause us to breach relevant laws, regulations, or licences, or where appropriate disposal facilities are not available.

8.5 The Customer acknowledges that certain items may incur additional charges due to specific regulatory or disposal requirements, such as electrical items, mattresses, or items containing hazardous components. Any such charges will be explained wherever reasonably possible before collection.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing the Services. However, our liability to the Customer is subject to the limitations set out in this section.

9.2 We will not be liable for any loss or damage arising from inaccurate information provided by the Customer, including misdescribed waste, hidden items, or incomplete instructions regarding which items are to be removed.

9.3 We will not be liable for any loss or damage resulting from pre-existing defects, structural weaknesses, or poor condition of any building, contents, fixtures, fittings, or surfaces at the Site.

9.4 If any damage to property is caused directly by our negligence, the Customer must notify us in writing as soon as reasonably practicable and in any event within 7 days of the Services being carried out. We may require evidence and an opportunity to inspect any alleged damage before accepting liability.

9.5 To the maximum extent permitted by law, we will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of opportunity, or loss of business, arising out of or in connection with the Services.

9.6 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.

9.7 Our total liability to the Customer for any loss or damage arising out of, or in connection with, the Services shall not exceed the total price paid by the Customer for the specific job in question, except where such limitation is not permitted by law.

10. Insurance

10.1 We maintain appropriate public liability insurance in respect of our waste removal activities, in line with industry practice.

10.2 Details of our insurance cover are available on request. Our insurance cover is subject to the terms, conditions, and exclusions imposed by our insurers, which may affect the extent of our liability.

11. Timing and Service Windows

11.1 Any arrival times or service windows provided at the time of booking are estimates only. While we endeavour to attend within the agreed window, delays may occur due to traffic, weather, or other factors beyond our control.

11.2 We shall not be liable for any loss, cost, or inconvenience arising from delays or changes in arrival time, provided we use reasonable efforts to keep the Customer informed and to complete the Services as soon as reasonably practicable.

12. Ownership of Items and Disposal

12.1 Once collected and loaded onto our vehicle, all waste and items become our property, and we will decide on the method of disposal, reuse, or recycling, subject to regulatory requirements.

12.2 The Customer should ensure that no valuable, sentimental, or wanted items are left among the waste to be removed. We do not accept responsibility for any such items that are inadvertently taken away.

13. Complaints and Disputes

13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible so that we have an opportunity to address the issue.

13.2 We will investigate complaints in a fair and timely manner and will work with the Customer to seek a reasonable resolution, which may include rectifying any shortfalls in the Services where appropriate.

13.3 If a dispute cannot be resolved directly, either party may consider using an appropriate alternative dispute resolution process, without prejudice to the right to bring legal proceedings.

14. Data Protection and Privacy

14.1 We will collect and use personal data from Customers only to the extent necessary to arrange and provide the Services, process payments, and manage our relationship with the Customer.

14.2 Personal data will be handled in accordance with applicable UK data protection laws. We will take reasonable steps to keep such data secure and will not sell personal information to third parties.

15. Variations to These Terms

15.1 We may amend or update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking.

15.2 Any variation to these Terms and Conditions requested by the Customer will be effective only if agreed by us in writing.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or confirmation issued by us, constitute the entire agreement between the Customer and the Company in relation to the Services, and supersede any prior discussions, correspondence, or understandings.

18.2 The Customer acknowledges that they have not relied on any statement, promise, or representation made or given by or on behalf of the Company that is not set out in these Terms and Conditions or in a written quotation or booking confirmation.
